No Opposition Leader / Party in Bihar – Constitutional Dilemma

It is the first time in Bihar that any opposition party is not able to win 10% of the seats in the state assembly. The opposition leader of previous assembly Rabri Devi has lost her both Raghopur and Sonepur seats. Now she will have to vacate her official residence.

The minimum seat to entitle for official opposition space is 10%. RJD with the alliance of LJP has 25 seats. But since the rules say "party" and not "alliance", the issue remains uncertain. The speaker of the new assembly will have to take a call. "Under the Constitution, t he RID does not qualify for the status of Opposition. According to Raghuvansh Prasad Singh senior leader of RJD and former chairman of the Bihar Legislative Council. such situation has emerged for the first time in Bihar, so this issue will be settled as per the legislative traditions in other states and Parliament.
